WORK FROM HOME

The successful candidate for this posting may be eligible for participation in a hybrid, work from home arrangement in alignment with the City’s Work from Home Policy. Such arrangements are determined with each employee and subject to change based on operational needs and policy direction.

 

FLEX

The successful candidate for this vacancy would participate in a modified work week, earning a flex day off each bi-weekly period by working additional time each day. Modified work weeks established in accordance with the CUPE Local 50 Collective Agreement and are subject to change.

 

POSITION FUNCTION                                       

In accordance with the Freedom of Information & Protection of Privacy Act (the Act), respond to City records access requests.  Develop and recommend policies and procedures for the efficient processing of records access and the security of sensitive third-party information, train City staff and act as a subject-matter resource for the City.

 

KEY DUTIES

Process access requests in accordance with the Act. Consult with applicants to

clarify the request and manage and direct on the collection of records responsive to FOI requests. Prepare and communicate fee estimates to applicants; identify records or parts of records that may be excepted from disclosure.  Consult with City staff and/or third parties for this purpose; make recommendations to the City’s FOIPPA Head regarding exceptions from disclosure, including research and interpretation of the Act to support recommendations; prepare and provide response to request; administering the records access process, including logging, updating and maintaining records access request files and databases, redacting documents for pro-active disclosure of City documentation.

 

Provide privacy advice to City staff and the public, and administer policies and procedures respecting the privacy provisions of FIPPA, including:  undertaking Privacy Impact Assessments (PIA), provide direction to staff undertaking PIA; administer information privacy protection policies and procedures to ensure the security of personal information held by the City; monitor and review corporate information privacy protection practices, identify and report deficiencies and making recommendations to the Head to improve practices. Investigate, contain and resolve minor information privacy breaches; provide process advice on major privacy breaches; assist in the preparation of materials to support the City’s response to a privacy complaint to the Office of the Information & Privacy Commissioner.

 

Develop, recommend, and implement policies and procedures that guide City processes respecting record access requests and information privacy protection, including researching and analysing the Act, case law respecting the Act and best practices. Analyse City policies and procedures to assess compliance with the Act and make recommendations to effect compliance with the Act; undertake assigned policy development initiatives to improve City policy and procedures and assist with implementation; advise City staff on the Act, and City policies and procedures that relate to the Act

 

Recommend and develop in-service training initiatives for City Staff regarding access requests and information privacy protection. Represent the City at external meetings and forums respecting the Act, including discussions, mediation and or investigations with the Office of the Information and Privacy Commissioner; respond to requests for consultation from other public bodies. 

 

Perform related duties where qualified.

INDEPENDENCE

Work is generated by requests from the public and staff or is assigned by supervisor.  

Issues such as final approval of recommendations respecting specific statutory functions or decisions under the Act are referred to the Head.

KEY SKILLS AND ABILITIES

Organize and prioritize work.

Understand and apply the principles of records management, legal and legislative research and policy analysis and development.

Working level operation of current City word processing, spreadsheet and related departmental software.

Synthesize and analyse information and compose reports and documents.

Interpret related policies, regulations, legislation and case law. 

Exercise judgment and make recommendations consistent with the law. 

Coordinate and facilitate training sessions. 

Maintain accurate records.

Establish and maintain effective working relationships.

Represent the City to the public and outside agencies. 

 

QUALIFICATIONS

Formal Education, Training and Occupational Certification:

Completion of a university undergraduate degree in Public Administration, Law, Information Management, Library or Archival Studies, or a related discipline. (4 years)  

Certified Information Privacy Professional (CIPP)

Experience:

5 years of related experience working in the field of records access and/or information privacy protection in a public body.

Or an equivalent combination of education and experience.

 

OTHER:

Maintain an up-to-date knowledge of relevant legislation and regulations.

May be requested to substitute in a more senior position.
